1. Acceptance of Terms

By accessing or using the Brand Velocity platform and website ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Brand Velocity provides an AI-native Marketing Operating System that includes data ingestion, AI-driven strategy recommendations, autonomous campaign execution, and continuous optimization services for B2C, D2C, and B2B2C brands.

3. Account Registration

To access certain features, you must register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate and complete information during registration.

4. Your Data

You retain all ownership rights to the data you provide to Brand Velocity. We process your data solely to provide the Service. We do not use your data to train models for other customers. You may request export or deletion of your data at any time.

5. Intellectual Property

The Brand Velocity platform, including its algorithms, UI, documentation, and brand assets, is our proprietary property. You may not copy, modify, distribute, or reverse-engineer any part of the Service without written permission.

Content generated by the platform using your data and brand guidelines belongs to you.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to access other users' data or accounts
• Interfere with or disrupt the Service's infrastructure
• Use the Service to generate misleading or fraudulent content
• Resell or redistribute the Service without authorization

7. Billing and Payment

Pricing is as described on our pricing page or in your individual service agreement. We reserve the right to modify pricing with 30 days' advance notice. Early access pricing is locked in for the duration of your founding customer agreement.

8. Limitation of Liability

Brand Velocity provides the Service "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the fees paid by you in the 12 months preceding the claim.

9. Termination

Either party may terminate the Service with 30 days' written notice. Upon termination, we will provide you an opportunity to export your data within 60 days, after which it will be permanently deleted from our systems.

10. Governing Law

These Terms are governed by the laws of India. Any disputes shall be resolved through arbitration in Bangalore, India, under the Indian Arbitration and Conciliation Act.
